TERMS AND CONDITIONS
Please take time to read the following in its entirety to completely understand the terms and conditions of essential factors when dealing with the purchase and maintenance of the window film material. You are solely responsible for reviewing our terms and conditions prior to submitting request to have work performed. We will begin work when approval has been provided per the completion and signature of our Customer Information Sheet and any additional requested documents.
ACCURACY OF SPECIFICATIONS: Estimates are based on the accuracy of the specifications provided to us by you, the customer. If we discover after accepting the job or vehicle that modifications need to be made we will notify you immediately, at which time a decision will be made whether there will be additional costs and how you wish for us to proceed. Any verbal requests or orders by the customer will be accepted, but in the absence of supportive documentation, simply design ltd (sdesign) will not be responsible for verbal mistakes. EVERYTHING MUST BE IN WRITING, Simply design ltd (sdesign) will not accept responsibility for the inaccuracies in orders telephoned in by the customer. We make every effort to quote a job accurately; but in the even of unforeseen circumstances or costs, we will notify you if there will need to be cost adjustment or if delays will result.
GENERAL TERMS AND CONDITIONS, TERMS OF PAYMENT, LEGAL FEES, AND DISPUTES: The customer agrees to make full payment prior to the release of the products or vehicle. The vehicle or products will not be released until full payment has been processed accordingly. Any invoice that is not paid at the time of order or delivery is considered past due and the customer is responsible for all collection fees including but not limited to attorney fees and court costs for unpaid balances at the interest rate of 18% per annum. This is not an expectation contract and we are not responsible for buyers’ remorse. By accepting the product or vehicle you are accepting the job as complete and that the performance is satisfactory. You are responsible for inspecting the product and or vehicle upon receipt. Customers shall identify to Simply design ltd (sdesign) in writing any dispute concerning an invoice within ten days of the date of the invoice. If disputes are not identified in writing within the ten-day time frame the customer has accepted the job and the invoice. Customers must contact Simply design ltd (sdesign) of any and all work in dispute, accompanied by written explanation. After investigation, if an error is found on our behalf we will make appropriate corrections.
Simply design ltd (sdesign) is not responsible for loss or damage to vehicle or articles left in vehicle in case of fire, theft, accident or any other cause beyond our control. We do not accept responsibility for consequential damages or loss of any kind related to the sale, installation or deliver of our products. It is the clients responsibility to read our Terms & Conditions available on our website prior to contacting Simply design ltd (sdesign) to perform any services. All quotations are valid for 30 days.
PAYMENT TERMS: Customer or assigned agent completing the Customer Information sheet agrees that they are the responsible party for payment of services requested. Customer or assigned agent agrees to make full payment prior to vehicle release and agree to be responsible for al collection fees including attorney fees and court costs for any unpaid balances at the interest rate of 18% per annum. Any custom ordered materials for the customer’s job is required to be paid for 100% prior to the order for the film before the work will be performed and are non-refundable. Any custom ordered window film for any project is paid for by the customer 100% prior to ordering the product. WE DO NOT ACCEPT CHECKS unless they are paid via certified funds and are pre-approved in writing by Simply design ltd (sdesign). A fee of £35.00 will be charged for any returned checks, in addition to the amount due. Any request changes to the description of services stated above need to be in writing and any additional charges incurred will be charged accordingly. Customer will pay the remaining balance including any additional cost or fees upon completion of the job prior to release of the vehicle.
CONDITION OF GLASS PRIOR TO WINDOW FILM INSTALLATION: Vehicles must be delivered to our location clean and free of grease, dirt, oil, dog hair, debris, and free from existing window film material. A cleaning charge of £75.00 per hour will be assessed for any additional cleaning or removal of existing window film material. Simply design ltd (sdesign) is not responsible for the condition of the surface the car is brought to us in. Any existing scratches, cracks or other damage will be visible through the film, and such surface damage or imperfections may damage the film, cause the film to fail prematurely or the window film material may not adhere to the surface at all. We are not responsible for broken windows if there is prior damage prior to installation. WE AR NOT RESPONSIBLE FOR THE CONDITION OF THE GLASS/VEHICLE PRIOR TO THE WINDOW FILM BEING INSTALLED OR WHAT IS UNDERNEATH THE WINDOW FILM ONCE IT IS INSTALLED.
RETURNS: Window film material is a non-returnable item once the material is ordered, cut and or installed per the customer’s personal request. Any custom ordered window film for any project is paid for by the customer 100% prior to ordering the product. If the job is cancelled or the customer does not want the product for any reason the film cost is non-refundable. All returns are at the discretion of Simply design ltd (sdesign). If the product is a returnable item there is a 25% restocking fee for the return and will be deducted from the initial cost of the product upon the return if applicable. If an issue arises the customer must submit their complaint in writing and give Simply design ltd (sdesign) the opportunity to see the issue and try and resolve the issue prior to pursuing any legal actions. Since all window film installations are customized to the customers specifications Simply design ltd (sdesign) must be given the opportunity to address any issues, including removal and reinstallation, before the client issues a credit card charge backs or check cancellations. In the event that the client does request a credit card charge back or check cancellation, the customer will be liable for all legal fees and or additional costs that were incurred to Simply design ltd (sdesign). If a credit card dispute is decided in the favor of Simply design ltd (sdesign) and we suffer any losses due to the client’s actions the client is liable for all legal fees, court costs, etc. If the customer fails to make full payment on an invoice then the customer authorizes Simply design ltd (sdesign) to remove the window film from the windows if installed. SINCE WINDOW FILM IS CUSTOM INSTALLED TO THE CUSTOMERS SPECIFICATIONS ONCE THE FILM IS CUT AND OR INSTALLED ALL CONTRACTS ARE FINAL AND NO MONETARY REFUNDS WILL BE ISSUED.
ESTIMATES: Estimates are good faith estimates and are based on the current information Simply design ltd (sdesign) has at the time the estimates are given. Estimates given are good for 30 days and are subject to change.
VEHICLE INSPECTION/CONDITION: Simply design ltd (sdesign) will complete a pre-inspection the day the car is delivered and alert the customer of any concerns prior to work being performed. We will also perform a post-inspection once the vehicle is completed prior to the release of the vehicle.
Simply design ltd (sdesign) is not responsible for the condition of the surface the of the vehicle or the glass prior to installation. Any existing scratches, cracks or other damage will be visible through the film, and such surface damage or imperfections may damage the film, cause the film to fail prematurely or the window film material may not adhere to the surface at all. We are not responsible for broken windows if there is existing damage prior to installation.
CONTENT: We reserve the right to refuse any work or vehicle for any reason.
INSTALLATIONS: Window film is a pliable material that is made to be installed on glass. We make every effort to make look as clean and seamless as possible, however, there may certain surfaces that window film will not adhere to such as plastic, rubber, dot matrix, etc. and customers are not advised to install on such areas. If the customer requests that these areas be installed we are not responsible for the material not sticking or adhering to those surfaces and the manufacture will not warranty such items.
Per the IWFA (International Window Film Association) The glass with applied films shall be viewed at right angles to the glass from the room side and at a distance no less than six (6) feet. Viewing shall be carried out in natural daylight, not in direct sun light. The installation is deemed acceptable if all of the following are unobtrusive (effects during 30-60 day cure time should be disregarded). Dirt Particles, Hair and Fibers, Adhesive Gels, Fingerprints, Air Bubbles, Water Haze, Scores and Scratches, Film Distortion, Creases, Edge Lifting, Nicks and Tears. If any of these conditions still exist after 30-60 days we request the customer return at such time to have us evaluate the film. WE CANNOT DO AN INSPECTION OVER THE PHONE, VIA EMAIL OR THROUGH PICTURES; WE MUST SEE THE VEHICLE/GLASS AT OUR LOCATION FOR INSPECTION.
ONCE INSTALLED WINDOW FILM MATERIAL IS INTENDED TO BE VIEWED FROM A DISTANCE OF SIX (6) FEET FROM THE GLASS AND IS DEEMED AS ACCEPTABLE.
While we make every effort to get the film as close to the edges as we can, when window film is installed there may be slight gaps. This allows for the water used in the installation to be squeegeed out. This also ensures that the film edges are not raised up by contact with the frame margin, dot matrix or other moldings, etc. Contact with the frame, dot matrix or moldings can lead to peeling of the film. A gap may also exist due to the type of glass or windows that the film is installed on, which Simply design ltd (sdesign) is not responsible for.
WINDOW FILM COMES IN MANY DIFFERENT SHADES, COLORS, AND OPTIONS AND IS SELECTED SOLEY BY THE CUSTOMER AND IS INSTALLED AT THEIR REQUEST. Simply design ltd (sdesign) IS NOT RESPONSIBLE FOR THE CUSTOMERS CHOICE IN FILM SELECTION OR FOR BUYERS REMORSE.
Installation time is based upon many factors including but not limited to, film selected, curing time, places where window film is being installed, size of windows, size of vehicle, complexity of installation areas and any unforeseen circumstances that may arise. We will make every effort to give reasonable time frames for instillation but reserve the right to change them at any time for any reason.
In most cases bubbles and haziness will subside in the 30-60 day cure time. We DO NOT require a 30-60 day check-up for window film. However if you see any areas of concern please return to our location with the vehicle so we can see the vehicle first hand and to be able to address any issues at that time. If you do not return within the 30-60 day required time frame to address any issues we are not responsible for the condition of the window film material or any installation issues. Simply design ltd (sdesign) is the installation company only we are not the manufacture.
REMOVALS: All removals for window film are quoted separately and are based on a per hour basis. Window film removal can be very time consuming and costly and is billed as such. Simply design ltd (sdesign) is not responsible for the condition of the glass underneath the film being removed or for any damage that occurs when such material is removed from the glass/vehicle. Simply design ltd (sdesign) is not responsible for any damage that occurs to the vehicle at the owner’s request.
WARRANTY AND MATERIALS: All materials are installed per the customer or authorized representatives request. We are not the manufacture of the product and all warranties are offered through the manufacture of the product the customer specifically ordered. For warranty information you must visit the manufacture website or brochure for specific information regarding the product(s) you ordered. Simply design ltd (sdesign) is the installer of the product, not the manufacture. However, if there is something wrong with the product our manufactures do stand behind their products as do we, so please do not hesitate to contact us. Damage done to the film by the customer or any third party is not a warranty issue and will not be covered as such. Simply design ltd (sdesign) is not liable for services that are contracted out to other facilities for work to be performed. If an issue arises the customer must contact that specific company directly for any warranty issues or concerns regarding that companies product or services.
AFTER CARE: Do not roll the windows down for the first 3-5 days after film is installed. You will see bubbles and haziness (the moisture between the glass and the film) in the windows until the film has fully cured. This can take 2-10 days depending upon the type of film you select and the environment your vehicle is stored in. Avoid using abrasive washing clothes as well as drying towels when cleaning the film. Do not use any ammonia-based products to clean the film, only use tint safe products. Be sure to return for your free 2-10 day check-up (ONLY IF NECESSARY). If you do need to return for any reason WE ASK THAT YOU PLEASE BRING A FRESHLY CLEANED CAR TO THE CHECK-UP SO WE CAN SEE AND ADDRESS ALL AREAS AT THAT TIME. We must physically see the vehicle or glass in person in order to address any issues, phone conversations, emails, or pictures will not suffice.
VEHICLE STORAGE FEES: Vehicles left beyond the authorized pickup day (definition of authorized pickup day: is the date vehicle is ready to be picked up and the client has been notified) will be charged £50.00 per day, per occupied space, until the vehicle or vehicles have been picked up and paid for.
VEHICLE MAINTENANCE/TOWING/TRANSPORTATION, ETC.: Simply design ltd (sdesign) is not responsible for the vehicles maintenance, condition or any mechanical malfunctions that may occur when the vehicle is in Simply design ltd (sdesign) possession. If a vehicle needs to be repaired or taken to a repair shop / dealership for any reason, including but not limited to: maintenance, recalls, electronic malfunctions, parts, etc. Simply design ltd (sdesign) is not responsible for any of the costs and is the owners sole responsibility to pay for those costs. Simply design ltd (sdesign) has permission to operate customers vehicle for services requested in work order. Operation of vehicles may include delivery, testing, and or outsourcing at difference locations.
CHANGES/CORRECTIONS/ERRORS: We reserve the right to correct inaccuracies, prices, omissions, descriptions, and errors relating to products, productions, availability and update information at anytime without prior notice.
ENTIRE AGREEMENT: This agreement may not be varied other than in writing, executed by the duly authorized representative of both parties. Clients and or authorized representative acknowledge that they have read and understand the terms and conditions and agree to accept these prices, fees, charges, conditions, and specifications listed herein and authorize Simply design ltd (sdesign) to perform all work as specified. Customer understands that we are not the manufacture of the products and that we do not guarantee the quality of the products provided to us by the manufacture. Customer or assigned agent agrees not to do harm to Simply design ltd (sdesign) by way of slander, via in-person, over the phone, in writing (published words), or by instructing other to do so as well. Any published statements made by a customer or its assigned agent must be approved by Simply design ltd (sdesign) prior to publication. In the event of any dispute, claim or controversy arising out of or relating to the information described in these Terms & Conditions all parties agree to resolution by Mediation/Binding Arbitration. The Mediation/Binding Arbitration will be administered in UNITED KINGDOM pursuant to comprehensive mediation and arbitration rules and procedures. If customer or assigned agent takes legal action against Simply design ltd (sdesign) for any of the information contained in this agreement the customer or assigned agent agrees to bear all legal fees and court costs. The validity and enforceability of this agreement will be interpreted in accordance with the laws in UNITED KINGDOM applicable to agreements entered in to and services performed in UNITED KINGDOM. If we must retain attorneys for any reason, we will be entitled to reasonable attorneys fees, court costs, administrative fees and interest at the maximum rate permitted by law.
I t is under costumer obligation to check the UK law and DVLA regulations regarding the services he asks for, Simply design is not responsible for any Mot failures or any insurance failures or accidents occured by opting for services that are not road legal (example: front windows tinted, front lights tinted etc.).

All designs and artwork remain property of Simply design Ltd (Sdesign). No part of any design or artwork may be used, reproduced, distributed or transmitted by any means strictly without prior written permission of the management of Simply design Ltd (Sdesign).
Any evidence of the use of Simply design Ltd (Sdesign) work, images & designs will be treated as theft and could lead to legal action to recover costs and damages.
It is the clients’ duty to check all artwork/designs before commencement of works begin. Any changes after approval will incur more charges.
Simply design Ltd (Sdesign) will provide a written quotation by email and/or on screen showing the total fee for work to be carried out at the relevant centre. Quotations are valid for 30 days, unless and until the workshop slot is either booked by a third party, or Simply design Ltd (Sdesign) receives a deposit for the same dates (or part thereof) from any party. Where the customer agrees by email, or other written device to book the workshop slot, Simply design Ltd (Sdesign) will provide a booking confirmation to the customer by email. The customer must pay the requested deposit or payment as defined on the booking confirmation prior to confirmation of the booking. During that period, Simply design Ltd (Sdesign) reserves the right to accept any booking for the workshop slot from a third party, where said third party agrees to payment prior to receipt of payment from the customer. On receipt of the required payment from the customer, Simply design Ltd (Sdesign) will issue a booking confirmation by email, to the customer.
Where the customer chooses to amend their booking 10 days or more prior to the workshop date agreed, resulting in a change of dates regarding workshop slots, a £100 Booking Administration Fee will be levied. Where the customer alters the booking resulting in a reduction in the cost subsequent to the initial quote, The Vinyl
Simply design Ltd (Sdesign) will charge the £100 work allocation administration Fee. Any changes to existing bookings within 7 days of arrival at one of our centers will normally not be permitted, but will try to accommodate where we can.
The customer agrees that on payment of the deposit sum to Simply design Ltd (Sdesign), the customer will signify their full acceptance of these Terms and Conditions of booking. The customer further acknowledges that full payment of the final sum will be made prior to collection of the customer vehicle(s).
Payments & Deposits
Deposits must be made at the time of booking. A standard booking fee of 20% of the total works must be made prior to booking confirmation. Simply design Ltd (Sdesign) reserves the right to request higher deposits or waiver, as and when the management deem suitable.
The customer agrees and acknowledges that Simply design Ltd (Sdesign) will not release the vehicle(s) or any goods prior to receipt by Simply design Ltd (Sdesign) of payment in full. Failure of the customer to pay in full for any service will result in removal or refusal to supply said service.
The customer agrees to pay the total fee as shown on the quotation as set out on the booking confirmation. Final and full payment is due on collection (Less the deposit received at the time of booking). In the event of late payment, or failure to pay, Simply design Ltd (Sdesign) reserves the rights to levy the cancellation penalty percentage charges against any money that the customer has paid in advance. Where the money paid in advance is insufficient to cover the calculated percentage, Simply design Ltd (Sdesign) reserves the right to exercise any legal remedies to pursue the amount owed by the customer.
Where the customer chooses to amend their booking 10 days or more prior to the workshop date agreed, resulting in a change of dates regarding workshop slots, a £100 Booking Administration Fee will be levied. Where the customer alters the booking resulting in a reduction in the cost subsequent to the initial quote, Simply design Ltd (Sdesign) will charge the £100 work allocation administration Fee. Any changes to existing bookings within 7 days of arrival at one of our centers will normally not be permitted, but will try to accommodate where we can.
Late payments of outstanding any outstanding balance will incur a charge of 2.5% of the total cost of works for every five working days of late payment. Simply design Ltd (Sdesign) reserves the right to change or waiver this charge if/where management deem suitable.
Late Collections/Pick ups
Simply design Ltd (Sdesign) reserves the right to charge storage of any vehicle or goods on the center sites, at £100.00 + VAT for every 5 working days that the vehicle/goods stays beyond the confirmed collection date. After 4 weeks, the charge will increase to £150.00 + VAT for every 5 working days thereafter. These charges will cover insurance and vehicle movements while collection is made.
After the initial 5 working days, the vehicle will be moved and stored outside of the center in question. Charges will still apply. Simply design Ltd (Sdesign) reserves the right to add this charge to the final payment /invoice and maintain the right to waiver these charges, as and when the management deem suitable.
The customer may cancel their booking at any time up to the workshop slot date in writing. In the event that the customer exercises their right to cancel, Simply design Ltd (Sdesign) will levy the following cancellation penalty percentage rates of the Total Rental Fee including deposit:
From initial date of booking up to 42 days prior to the workshop slot date 100% Return of Deposit
Between 30 and 41 days prior to the workshop slot date 75% Return of Deposit
Between 15 and 29 days prior to the workshop slot date 50% Return of Deposit
Less than 14 days prior to the workshop slot date 0% Return of Deposit
Simply design Ltd (Sdesign) regrets that it is unable to waive any of the cancellation charges above, whatever the circumstances.
Vehicle Conditions & Paint
Simply design Ltd (Sdesign) requests all customers to deliver vehicles clean, dry (where possible) & free from grease and wax.
Prior to booking/works, paint & bodywork will have been checked and noted, advising of any unsuitable areas and potential issues or risk. These areas must be dealt with prior to works commencing, with both the customer and Simply design Ltd (Sdesign) agreeing that these areas are acceptable or accept that highlighted areas will not have any guarantees or warranties for workmanship or material quality.
Areas that have received repair, or are suspected of receiving repair, will not be guaranteed or warranted inline with the film manufacturers warranty statements and Simply design Ltd (Sdesign)’s terms and conditions.
If repairs are to be carried out prior to any vehicle wrap work and booking, the paints must be fully cured and out gassed inline with the paint manufacturers technical instructions before any livery/wrap can be applied. Simply design Ltd (Sdesign) gives no warranty or guarantee to panels or areas that have received remedial or re-spray/smart repair work undertaken.
Any vehicle with additional damage from between the initial consultation, to the booked in date, will be highlighted and pointed out before work commences. Any additional damage needing repair will need to be re-booked but may still be charged.
Vehicles with unsuitable paint or bodywork will need the customer to sign a waiver before any work will commence, ensuring any works or materials by Simply design Ltd (Sdesign) are not liable against guarantees or warranties thereafter.
Failure to meet any of the above points or requests may result in the works being cancelled and full charge being applied.
Please note, that Simply design Ltd (Sdesign) will not be held responsible for the replacement of vehicle furniture on any vehicle where application requires anything to be removed. Some clips and moldings are not designed for more than one fixing. Simply design Ltd (Sdesign) will also not be held responsible for vehicle badges or parts that need to be removed and/or are damaged during the application process.
While Simply design Ltd (Sdesign) will give the best quality of work and materials, it is the customers’ responsibility to maintain the aftercare and appearance of their wrap/livery after handover.
Keeping your vehicle clean and free from dirt will always help maintain the look of your wrap/livery like any painted surface.
Please do not use any harsh chemicals with your cleaning process to help prevent any reaction to our materials.
Allow 5 days after the installation of work before washing the vehicle for the first time. Strictly hand -wash the vehicle only. DO NOT USE pressure washers/automatic washers.
Ensure you clean your vehicle from the top to bottom, allowing dirt and water to run downwards.
Wipe spillages, diesel/petro/bird droppings etc., from the film as quickly as possible.
Although some companies claim to have wrap waxes and polishes, we do not recommend any products 100%. If you intend to use any waxes/polishes, please try on your wrap/livery in a small inconspicuous area first.
Additional charges will be incurred due to, but not exclusively to –
Vehicle not clean on arrival (Cleaning charges of – £50 per car/ £75 per van / £125 per HGV cabs)
Late collections (as stated above)
Amendments to design (as stated above)
Cancellations (as stated above)
Failure of client not able to receive / sign for vehicle delivered to site as arranged. £50 per hour waiting
Works will be completed as quickly and efficiently as possible. In the unlikely event of a delay to any works, Simply design Ltd (Sdesign) will not be liable for any loss or damage arising from a delay in completing all or part of the projects ordered or confirmed.
Simply design Ltd (Sdesign) has no insurable interest in any customers vehicles delivered to our premises and cannot be held responsible for loss or damage to customer’s vehicles/goods. It is the responsibility of our clients/customers to ensure their vehicles/goods are fully insured whilst on Simply design Ltd (Sdesign) premises.
All standard wraps supplied and installed by Simply design Ltd (Sdesign) staff will include a application guarantee of 2 years and a manufacturers guarantee of between 3 to 7 years dependent on the material chosen for the wrap/livery.
Warranties/Guaranties are only valid if material is supplied by Simply design Ltd (Sdesign) and is installed at one of our centers.
Repeat orders or crash damage may occasionally require new material orders or productions. These may, on rare occasions, have slight colour differences from time to time, due to suppliers or
manufacturers batch numbers. Simply design Ltd (Sdesign) accepts no responsibility for these issues.
Any guarantee/warranty that is in place is only valid between the paying client and Simply design Ltd (Sdesign) and strictly none transferable to any third party.
